Stage 1 – Prepare Contract
In order to put your house on the market in Sydney New South Wale (NSW) , you must first prepare a Contract for Sale. This can be done by your Conveyancing Solicitor or Conveyancer or Conveyancing lawyer. This is so that any potential buyer can obtain the Contract and seek legal advice on the property contract.
The Contract for Sale must contain all the details and conditions of you property and the sale of your property, including:
- Details of the mortgage if there is one attached to the property.
- A title search with a listing of any restrictions or easements affecting the use of the property in question.
- A zoning certificate from council showing the zoning – i.e. residential, commercial etc.
- A property diagram showing the main sewer line crossing the property.
- Vendor disclosure
- By laws
- special conditions
- any covenants and caveats on title
If a potential buyer decides to request the contract – we send a copy to their chosen legal representative or the real estate agent can arrange for this.
After a potential buyer has had sufficient time to browse the contract and get advice from their conveyancer, they may request amendments to the contract. Most contracts for sale are template these days and changes will only be reflective of the actual property itself or terms of settlement.
We will make any changes agreed to by yourself and forward the amended contract back to the buyer’s solicitor.
